Cowboys Owner Jerry Jones asked a Dallas federal court to quash any attempt to call him as a witness in the ongoing Super Bowl ticket trial. U.S. District Judge Barbara Lynn reportedly told attorneys this week she was leaning toward calling Jones as a witness. It was apparently in response to the judge's comment on Jones' recent motion, which read, “(T)he only testimony that could be elicited from Mr. Jones is not relevant to any remaining causes of action or issues in dispute in this matter.” The motion does not dispute Jones wanted to set an attendance record at the '11 Super Bowl, where 1,200 fans did not get their assigned seats or had their view blocked because of temporary seats that were not ready. However, Jones disputes his desire for the attendance record – which was not set – caused the issues with seating.
The plaintiffs in the case responded with their own motion, contending they need to call Jones to test what others have testified to. “Without Mr. Jones’ testimony, the Plaintiffs are placed in the untenable position of trying to prove what Mr. Jones told the NFL, and whether the NFL reliance on his assurance was reasonable, without Mr. Jones – a witness who is both local and available,” the plaintiffs contended in their motion. Jones and the Cowboys are not defendants in the case, which is scheduled to run through next week.
