NFL Looking For New CMO, With Mark Waller Changing Roles

By Daniel Kaplan

The NFL is conducting a search for a new CMO after a series of high-level organizational changes, outlined in a memo sent today by NFL Commissioner Roger Goodell to teams and league officials. Mark Waller is dropping his CMO title to fully focus on international, a role he previously had before taking over marketing. He will be promoted to Exec VP and report directly to Goodell. Waller joined the NFL in '06 to run international and assumed the CMO role in '09.

Eric Grubman will focus on "critical league priorities, including stadium development, the return of a team presence to the Los Angeles area, the league’s strategic investment fund, and other key strategic initiatives," Goodell wrote. Grubman had been Exec VP/NFL Ventures & Business Operations. NFL Exec VP/Media and NFL Network President & COO Brian Rolapp adds consumer products to his oversight, according to the memo. Chris Halpin will be promoted to Senior VP and have responsibility for Consumer Products, the commissioner wrote.

The new CMO will oversee events. Previously, events reported to Grubman, who will continue to oversee the area until a new CMO is found. The NFL last week promoted Peter O'Reilly to Senior VP/Events, replacing Frank Supovitz. The memo also noted Jeff Miller, who runs security, is promoted to Senior VP.

NCAA COO Jim Isch To Retire From Organization In Early '15

The NCAA today said that COO Jim Isch will retire in early '15 after transitioning away from his current position this fall into an advisory role to NCAA President Mark Emmert. Isch has worked at the NCAA since '98. With Isch's departure, Emmert announced a reorganization of senior staff, including the creation of a new Exec VP position to oversee all regulatory matters. The COO duties will be reallocated to other staff. A committee of member reps and national office staff, chaired by Big 12 Commissioner Bob Bowlsby, will guide an outside firm in a national search for a new Exec VP (NCAA).

NFLPA's DeMaurice Smith: Players "Committed To The Issue Of Safety"

NFLPA Exec Dir DeMaurice Smith appeared on ESPN's "SportsCenter" this morning to discuss the penalties being meted out to players for violent hits to the head. On the issue of whether players feel the league should be doing more for player safety, Smith said, "We have a group of players who have been committed to the issue of safety for decades. … Every year we take a look at the range of issues that affect player safety: their interaction with their team doctors, field issues, equipment issues, enforcement-of-rule issues. We're always striving to try to come up with ways to make a very violent game safer each and every day. If those are things that we can do a better job of, I know that we and the league agree that there are things we should always be striving for."

Smith said of the firestorm surrounding the punishment Ravens RB Ray Rice received for his domestic abuse case, "The punishment needs to fit the crime, but I also believe that we need to make sure that we are impressing upon our young men that they need to be good husbands, good fathers, good members of their community" ("SportsCenter," ESPN, 8/26).

Illinois Court Schedules Trial In American Needle Suit Against NFL

By Daniel Kaplan

An Illinois federal court scheduled a jury trial for next fall for American Needle's antitrust lawsuit against the NFL. That would come a full 16 years after the event that sparked the lawsuit: the NFL's award of an exclusive cap license to Reebok. American Needle in '04 sued under antitrust law, but the NFL countered it was exempt from antitrust rules for the purpose of such commercial contracts. The case made it to the Supreme Court, which ruled in '10 that the NFL was not exempt and would have to defend itself.

Four years later, after settlement talks earlier this summer, the parties will move toward a trial date on either October 28, 2015, or November 2, 2015, the court wrote in a notice. The contract at issue has long since expired. Nike took over for Reebok in '11 as the league's apparel provider. New Era caps currently has the exclusive cap license.
