Florida Judge Refuses To Dismiss MLB Lawsuit In Biogenesis Case

Miami-Dade County Circuit Court Judge Ronald Dresnick yesterday rejected a motion to dismiss a lawsuit filed by MLB that claims former Biogenesis Owner Anthony Bosch "interfered" with MLB player contracts "when he and his associates supplied banned drugs to the players." An attorney for Carlos Acevedo, one of the defendants, had argued that the suit should be dismissed "because MLB had failed to include an indispensable party" – the MLBPA – in the suit, and because MLB lawyers "have not proved that the defendants interfered in MLB's basic agreement with its union" (N.Y. DAILY NEWS, 6/13).

The lawsuit has been a "powerful leverage tool for MLB as it tries to coerce cooperation from anyone who can aid its investigation." While some legal experts "have questioned whether MLB could win in court, the lawsuit has forced defendants into a potentially costly legal battle to find out" (ESPN.com, 6/12).
