Former UFC Fighter Josh Barnett Suing Nutrient Manufacturer

Former UFC fighter JOSH BARNETT is suing the manufacturer of a nutritional supplement alleging the product caused him to unknowingly ingest a prohibited substance that caused him to fail a test under the UFC anti-doping policy. Barnett is asking for a jury trial and unspecified damages against supplement company Genkor, alleging negligence, breach of implied warranty, breach of express warranty in a lawsuit filed Tuesday in L.A. Superior Court. The suit alleges Barnett suffered and "continues to suffer substantial damages as a result of the incident, including, but not limited to, lost UFC fight purses, attorney fees and expenses." Genkor did not immediately respond to a request for comment. The lawsuit comes after an arbitrator ruled late last month that Barnett unknowingly ingested a prohibited substance. Arbitrator RICHARD MCLAREN ruled Barnett is "not a drug cheat" in late March in an arbitration Barnett brought against USADA, the UFC's outside drug testing agency. Barnett tested positive for the drug Ostarine after providing USADA with a urine sample in December '16.
