Court Rules Davis Has No Right To Sue NFL |
A lawsuit filed by the Raiders that claims the NFL and NFL Commissioner Paul Tagliabue “mishandled league finances was thrown out of court again Thursday” by the California State Court of Appeal, according to the OAKLAND TRIBUNE. The court agreed with a lower court that concluded Raiders Owner Al Davis “had no right to sue the NFL because the dispute was among members of a private voluntary association.” Davis filed the suit in ’95, claiming that Tagliabue forced “teams to pay into the World League of American Football,” now known as NFL Europe. The suit also stated that the league “mismanaged executive salary benefits and discriminated against the Raiders by not placing Davis on several different committees.” The suit was filed with a larger antitrust suit against the NFL in which Davis “claimed the league ruined his team’s opportunity to build a new stadium in” L.A. That case is now before the California Supreme Court. Raiders attorney Ken Hausman noted that the misspending suit resulted in the NFL “refunding the Raiders for some World League activities” (
OAKLAND TRIBUNE, 7/29).
