Spanish Club Ourense Urges ACB To Accept CSD Ruling, Include Club In '15-16

Spanish basketball club Ourense President Antonio Gavilanes has urged the Spanish Basketball League (ACB) to comply with Spain's Superior Sports Council's (CSD) ruling and include the club in the '15-16 ACB season, according to the EFE. Gavilanes: "The resolution of the CSD is clear and emphatic, the club meets the premises set by the ACB, which means Ourense has to be an ACB team." Gavilanes, however, explained that Ourense still is not "100%" an ACB team, as the league could appeal the resolution adopted by the CSD. He said, "We will work as an ACB team in all regards as we have the support of the CSD. With everything, we want a cordial process with the League. Our attitude is to collaborate with the ACB, yesterday we sent a letter to formalize our registration in the League" (EFE, 8/12). MARCA reported the ACB expressed in a statement its discomfort with the CSD's ruling, which it called "contradictory to the regulation established in the ACB's Statutes & Regulations, approved by the CSD itself." It also believes the decision "generates serious legal insecurity both in the application of the rules of economic control and in the processes of promotion and relegation." The ACB "could appeal the CSD's resolution" before Spain's National Court. The ACB announced its schedule and "has in its power the pairings ... with 18 teams." If there are 19 teams, the ACB "would have to modify the schedule and there are no dates to fit the new matchdays" (MARCA, 8/12).
