NY APPELLATE COURT RULES IN FAVOR OF GIULIANI ON BALLPARK

          A five-judge panel of the NY State Supreme Court
     Appellate Division unanimously ruled that the proposed
     referendum on the future of Yankee Stadium "be kept off the
     November ballot," according to Rubinowitz, Seifman, Montero,
     Weisman & Gregorian of the N.Y. POST.  Mayor Rudy Giuliani
     "blocked the referendum by appointing a Charter Revision
     Commission, which will put a question about finance reform
     on the ballot instead," and the Appellate Division ruled
     "the commission was appointed legally."  While Corporation
     Counsel Michael Hess called the referendum "dead," N.Y. City
     Council Speaker Peter Vallone said "the referendum is very
     much alive. ...The only ruling is you can't have it on Nov.
     3 ... That doesn't mean it can't be on Nov. 4 or 5."  City
     Council lawyers said that they "would immediately petition
     to appeal to a higher court" (N.Y. POST, 10/18).
