FAIRWAY TO HEAVEN FILES SUIT TO KEEP OTHERS OFF ITS COURSE

NY-based Fairway to Heaven (FTH), Inc. has filed a
preliminary injunction against Viacom Int'l (VH-1, MTV
Networks) and NJ-based GlenGate Apparel for infringement of
FTH's federally registered trademark "Fairway to Heaven."
FTH, which has been selling clothing products under this
trademark, has previously filed a suit in U.S. Federal
District Court for the Southern District of NY seeking
damages and an injunction prohibiting Viacom and GlenGate
from further infringing its mark. FTH intends to hold all
retailers who attempt to sell the Viacom and GlenGate
clothing products which infringe FTH's trademark for damages
as well (FTH). GlenGate signed an exclusive deal with VH1
to produce and distribute a "Fairway to Heaven" youth-
inspired golf apparel line in October '97 (THE DAILY).
