APPEALS COURT ORDERS SEIZURE OF COUNTERFEIT NBA MERCHANDISE

          Acting on an "emergency appeal" by the NBA, a three-
     judge Circuit Court of Appeals panel in Denver reversed a
     District Court ruling, leading to the seizure of counterfeit
     sports merchandise from "unnamed peddlers," according to Joe
     Costanzo in the DESERET NEWS.  Last week, the NBA asked U.S.
     District Judge Tena Campbell to order U.S. marshals and
     police to seize any "phony" goods found within ten miles of
     the Delta Center, but the request was blocked by Campbell's
     "surprise ruling" against it.  The appeals panel concluded
     the district court's finding that the NBA couldn't target
     specific locations or property for an injunction or seizure
     "is not supported by the record" (DESERET NEWS, 5/23). 
     Campbell has now issued a temporary restraining order
     "forbidding" the further selling of fake NBA goods and
     requiring the U.S. marshal to seize all such goods within 15
     miles of the Delta Center (DESERET NEWS, 5/27).
