ATP Lawyers To Depose Reps Of Tennis Federations Over Legal Fees

ATP lawyers today are scheduled to depose reps of the German and Qatar tennis federations, the losing plaintiffs in an antitrust lawsuit filed against the ATP in '08. At issue is whether the plaintiffs should pay the roughly $20M legal tab the ATP incurred. The two federations sued the ATP for demoting their Hamburg, Germany, event. Shortly before that demotion, the ATP adopted a bylaw that a member that sues the tour and loses pays the legal fees. At issue is whether the bylaw is legal.

The case has ground through the Delaware federal and state courts. According to filings made in the case, the deposition is scheduled for this afternoon at ATP counsel Proskauer’s office and would carry into next week if needed.
