Latest Appeal In Ongoing MASN Case Dismissed By New York Court

The New York Court of Appeals today dismissed a bid by MASN to appeal as a matter of right a prior decision that would return the long-running media dispute with the Nationals back to MLB’s internal arbitration panel. The ruling was made on the grounds that the Orioles-controlled MASN did not have constitutional grounds to appeal in this fashion. The RSN has already refiled its appeal under another form as it continues to seek a neutral forum to rehear the matter away from MLB’s Revenue Sharing Definitions Committee. “Today’s action just means that MASN’s appeal should proceed through a different procedural route,” said MASN attorney Thomas Hall. “Having won vacatur of the prior award due to MLB’s evident partiality and disregard for fundamental fairness, MASN will continue to press its appeal on the question of whether MLB is disqualified from rehearing the parties’ right fees dispute.”
