JOE MONTANA is the "latest to sue" over S.F.'s "troubled Millennium Tower, alleging in court documents filed last week that the building's developer concealed evidence that the luxury high-rise is sinking." This comes "even as the company asked" Montana to "promote condominium sales there." Montana and his wife, JENNIFER, got a "reduced price to lease a condo at the exclusive property" in '10, then to "buy the unit three years later." The couple "agreed to make promotional pitches for the tower and allow the developer to use their names for marketing the complex." The Montanas are seeking $2.7M in "reimbursement for buying the condo" and $1M for "consequential damages" from marketing, among other compensation (S.F. CHRONICLE, 5/9).

THE GOOD STUFF: The Cowboys yesterday held their sixth annual Reliant Home Run Derby at Dr. Pepper Ballpark in Frisco, and coach JASON GARRETT won for the second time, "raising $4,900 to edge out" TE JASON WITTEN by $100. A roster that also included QB DAK PRESCOTT and RB EZEKIEL ELLIOTT "partnered with Reliant to raise $50,000 for the Salvation Army" (DALLASNEWS.com, 5/8)....The Ann & Robert H. Lurie Children's Hospital of Chicago has recieved a $3.5M donation from Cubs 1B ANTHONY RIZZO's foundation to "create two endowed funds" (CHICAGO SUN-TIMES, 5/9)....Fox NFL analyst DAVID DIEHL's annual charity golf tournament, the Clara Maass Medical Center Golf Invitational, was held yesterday at Montclair Golf Club. The 240-player event was "expected to raise just over $300,000, the most in the event's history," to support the RWJBarnabas Health's Clara Maass Medical Center in Belleville, N.J. (NJ.com, 5/9)....Eagles WR TORREY SMITH and his wife “made a huge donation” to the Baltimore Animal Rescue & Care Shelter after Saturday’s Pawject Runway fundraiser, “covering the adoption fees for every dog and cat at the event.” They also “made an extra donation on top of the adoption fees” (BALTIMORESUN.com, 5/8).

NAMES: Former Redskins GM SCOT MCCLOUGHAN has “put two” signed hats up on eBay, with plans to “donate the money raised to the Redskins Charitable Foundation” (WASHINGTONPOST.com, 5/8)....Heat F CHRIS BOSH and his wife are “being sued” by a company that “produces pornographic videos.” The creators of X-Art, a company that “shoots erotic videos and photographs in high class settings, rented a beach mansion in Pacific Palisades” owned by the Bosh’s. COLETTE and BRIGHAM FIELD, who created X-Art, said that “soon after moving into the 10,755 square foot mansion they noticed toxic mold, leaks, plumbing issues and rat droppings” (PALMBEACHPOST.com, 5/8)....LEON SMITH, who “operated Lexington-based Legacy Pro Management Group and Legacy Athlete Management," has been "charged with 14 counts of fraud involving four unnamed athletes” from '11-15. Sources said that among the four alleged victims are Jazz G SHELVIN MACK and former NBAers DARIUS MILLER and JOSH HARRELLSON (SPORTS.YAHOO.com, 5/8)....Former U.S. Sen. SCOTT BROWN (R-Mass.) and musician DANNY KLEIN joined former NFLer DOUG FLUTIE on Saturday at the Flutie Foundation's annual gala in Needham, Mass. IN MEMORY: Former Canadiens Owner & President JOHN DAVID MOLSON has "died at the age of 88." Molson was president from '64-72, a span during which the team won five Stanley Cups (MONTREAL GAZETTE, 5/9).
