Rosenhaus Asks Judge To Send DeSean Jackson Dispute To Union Arbitrator

Attorneys for NFL agent Drew Rosenhaus have asked a federal court judge to send his dispute against former client, Redskins WR DeSean Jackson, back to the NFLPA for a rehearing before a union arbitrator. Judge Michael Fitzgerald in February vacated NFLPA arbitrator Roger Kaplan’s $516,415 award in favor of Rosenhaus and against Jackson. Fitzgerald found that Jackson should have been told Kaplan had worked for and was paid by Rosenhaus to arbitrate a dispute involving one of his former employees. In the motion, filed Friday by Rosenhaus attorneys Darren Heitner and David Dickieson, the agent asks that  Fitzgerald amend his Feb. 26 order “to explicitly indicate that the case is remanded for a rehearing before an arbitrator selected by the NFLPA.” Fitzgerald’s order implies, but does not explicitly state, that the matter be sent back to the NFLPA for a rehearing, Rosenhaus argued in the motion. “Without remanding the matter to arbitration for a rehearing, Petitioner Rosenhaus would suffer injustice and prejudice and would be denied an opportunity for a decision on the merits,” according to the motion. “His grievance against Respondent Jackson would be left undecided, despite no fault of his own.”
