Texas A&M Donors Suing 12th Man Foundation After Losing Seats In Stadium Upgrade

Texas A&M football fans "upset about losing their prime spots" in the $485M expansion of Kyle Field yesterday filed a federal class-action lawsuit against the school's 12th Man Foundation to "hold onto their seats," according to Max Baker of the FT. WORTH STAR-TELEGRAM. The attorneys are "seeking class-action certification so they can ultimately represent about 450 endowments, or about 1,700 of the 102,500 seats in the stadium." They also want the judge to "issue a temporary restraining order to 'maintain the status quo' preventing the foundation from redistributing their seats during a reseating program that is set to begin Monday and run through May" (FT. WORTH STAR-TELEGRAM, 3/12). In Houston, David Barron notes seating for long-term donors and season-ticket holders "has become an issue" during the Kyle Field renovation (HOUSTON CHRONICLE, 3/12).  Barron noted the suit "accuses the foundation of reneging on endowment agreements dating back to the 1980s in an effort to coerce more money out of longtime university donors and A&M football fans." This is the "first, all-encompassing complaint against the foundation’s redevelopment and reseating plan for the stadium’s west side, which is ramping up in anticipation" of the '15 season (CHRON.com, 3/11).
