ATLANTA JUDGE SET TO ISSUE TURNER SOUTH RULING IN 10 DAYS

          The Thrashers "should know in the next 10 days whether
     their first NHL game" will be televised on Turner South,
     according to Prentis Rogers of the ATLANTA CONSTITUTION.
     Fulton County Superior Court Judge Roland Barnes "indicated
     during a hearing Friday that he would issue an order" by
     September 7 on Fox Sports Net South's (FSNS) "attempts to
     prevent Turner South from starting" on October 1 with
     Thrashers, Braves and Hawks games "as part of its
     programming."  FSNS attorney Emmet Bondurant said his client
     "was not trying to stop Turner South, just the broadcasts"
     of Thrashers, Braves and Hawks games, which he said made it
     an RSN "in substance."  But Turner attorney Jack Dalton said
     Turner South does not break any previous agreement between
     the nets and noted that Turner South is an "entertainment"
     network: "The prohibition was only against a regional sports
     network. ... The average percentage of sports on
     entertainment networks in the industry is 6.5 percent, and
     we're about half of that [at 3.3%]" (CONSTITUTION, 8/28).
