THE GOODENOW AND THE BAD: JUDGE DOESN'T BELIEVE TESTIMONY

NLRB Judge Margaret Kern ruled in favor of the NHLPA's
"several complaints of unfair labour practice against the
NHL," but she concluded in one decision that the testimony
of NHLPA Exec Dir Bob Goodenow and union lawyers Ian Pulver
and Jeff Citron was "not credible," according to Alan Adams
of the NATIONAL POST. Kern ruled that the NHL "violated
U.S. labour law when it refused to provide the NHLPA with a
breakdown of subsidy payments," but "did not believe"
Goodenow, Pulver and Citron when they "denied reading"
reports published in '95 about the NHL's subsidy program to
aid the Flames, Oilers and Senators. Kern also ruled that
the NHL "violated labour law by refusing to provide the
NHLPA with copies of all trade memos" from '96-97 to
present. Adams writes that that decision is "seen as an
important win for the players" because they now have access
to "detailed information about salaries, deferred salaries
and tax-related issues" (NATIONAL POST, 6/18).
