The Heat asked the Third District Court of Appeals to remove
the "controversial" arena question off the November 5 ballot
because it "lumps together more than one issue," according to"
Larry Lebowitz in the Fort Lauderdale SUN SENTINEL. The Heat
have previously asked Dade Circuit Judge Ronald Friedman to issue
a ruling before the election, but Friedman has said he will not
release his decision until 8pm ET November 5. The team asked the
state appeals court "to force" Friedman to issue a ruling.
Lebowitz adds the Court of Appeals "didn't appear to be buying
into the Heat's sense of urgency" (Fort Lauderdale SUN SENTINEL,
10/23).
HEAT AD, TAKE FOUR: Lebowitz reviews the Heat's fourth ad in
their campaign to for a new $165M Dade County waterfront arena.
The ad, titled "No" is paid for by the Coalition for a Greater
Miami, and produced by Murphy, Pintak, Gautier in McLean, Va.

Lebowitz calls it the "most factually distorted ad of the
campaign" as existing tourist taxes only part for part of the
development. Lebowitz notes the ad never mentions the word
"arena" (Fort Lauderdale SUN SENTINEL, 10/23).
