THE COURT BATTLE FOR INDY CAR RIGHTS CONTINUES

It appears that two courts will have to decide the legal
battles over the Indy car brand name, according to Bill Koenig of
the INDIANAPOLIS STAR-NEWS. Last week, Judge John Tinder of U.S.
District Court in Indianapolis ruled that an antitrust lawsuit
filed by Indianapolis Motor Speedway will be decided at an IN
Federal Court. The May lawsuit, filed in Indianapolis, claimed
that CART teams "unfairly monopolized Indy-style auto racing."
Previously, it was decided that a U.S. District Court Judge in
Detroit would oversee a suit filed by CART against the Speedway
in which CART claimed it had the legal right to use the "IndyCar"
brand name. Lawyers said that, so far, activity in the suits has
involved procedure and not addressed the major issues
(INDIANAPOLIS STAR-NEWS, 7/18).
