Advocacy Group Seeks To File Brief In NFL Concussion Settlement Case

Advocacy group Public Citizen asked the Third Circuit Court of Appeals today for permission to file a friend of the court brief supporting the objections filed by seven former NFLers to the preliminary approval of the class action concussion settlement. The seven players earlier this week objected to the lower court’s approval, contending the proposed class did not pass legal muster. Public Citizen writes in its 18-page motion that the Appeals Court “should at a minimum address the fundamental requisites of adequate representation that require that the agreement be renegotiated before class members are required to participate in a fairness hearing that is doomed to produce an indefensible result.”

The seven former players contend because their health ailments are not fully covered by the proposed settlement, the class does not represent them.
