Source: MLS Seeking Force Majeure Clause In Negotiations With Union


For weeks now, multiple sources have indicated that MLS would attempt to negotiate with the MLSPA a force majeure clause as the two sides discuss return-to-play scenarios, player salary cuts and the CBA, which was agreed to in principle earlier this year but has yet to be ratified. Neither the old nor new CBA included a force majeure provision that would give the league and its owners the unilateral right to slash player pay amid a crisis, like the current coronavirus pandemic. The league’s most recent counterproposal to the union’s reported $100M offer in economic relief included a first draft of a force majeure clause, according to a source with knowledge of the situation. This person declined to discuss the league’s counterproposal in financial detail, only saying that it was a “productive counter.” MLS declined comment while the MLSPA could not be reached for comment.
