Australian Sports Anti-Doping Authority Denies James Hird Right Of Reply

Australian Sports Anti-Doping Authority investigators "failed to recall James Hird to respond to damaging allegations against him despite telling his lawyers he would be given an opportunity to give further evidence," according to Chip Le Grand of THE AUSTRALIAN. The failure to give Hird a right of reply "left untested the veracity of key evidence relied on by ASADA," and the Australian Football League "to portray Hird as a driving force behind the supplement treatments which spun out of control at Essendon throughout the 2012 season." One of the allegations not put to Hird "was that he was warned off peptides by AFL integrity officer Brett Clothier during a meeting on August 5, 2011." Clothier's account of the meeting, in which he told Hird that peptides "were a serious risk to the integrity of the AFL and 'implored' Hird to report to the AFL any information he came across relating to their use, was never put to Hird." On multiple occasions, ASADA lead investigator John Nolan and Hird's legal team "discussed the need for Hird to re-appear before ASADA." As late as June, Nolan "indicated to one of Hird's lawyers that he would be recalled." Hird's lawyers in a letter to ASADA described the failure to recall Hird as an "egregious failure to afford our client natural justice" (THE AUSTRALIAN, 12/9).
