Howard Weitzman, attorney for NBA agent Dan Fegan, in a statement to THE DAILY late Friday said he intends to present new evidence to a judge to lift a restraining order preventing Fegan from competing with his former employer, Independent Sports & Entertainment. The TRO expires on April 6, and there is a hearing that day to determine whether L.A. Superior Court Judge Mary Strobel will issue a a longer injunction. ISE is being represented in the litigation by L.A.-based Gibson Dunn & Crutcher. A partner from the firm, James Fogelman, in a statement to THE DAILY said, "We thank the court for giving us a fair and impartial hearing. As ISE alleges in the complaint, Mr. Fegan’s conduct was unacceptable and we are pleased that the court recognized that ISE is likely to prevail on its claim that Mr. Fegan's actions constituted willful misconduct in breach of the parties' Agreement. We look forward to our next opportunity to address these issues in April."
