Judge Denies NCAA's Motion To Dismiss O'Bannon/Keller Lawsuit

U.S. District Court Judge Claudia Wilken Friday denied motions from the NCAA and other defendants to dismiss an antitrust lawsuit brought by Sam Keller and Ed O'Bannon "pertaining to the use of college athletes’ names and likenesses.” Wilken ruled that “none of the three arguments that the NCAA offered for dismissal ‘provides grounds for dimissing Plaintiff’s claims at this stage.’” The ruling “sets the stage for another key ruling that is pending in the case – whether to certify the case as a class action” (USATODAY.com, 10/25).
