Balsillie, Moyes Ask Judge To Force NHL To Negotiate On Coyotes

Balsillie Says He'd Pay A
"Reasonable" Relocation Fee
RIM co-CEO Jim Balsillie and Coyotes Owner Jerry Moyes “want a bankruptcy court judge to force the NHL to negotiate with them the possible relocation of the team to Hamilton, just in case no buyer is found to keep the team in Arizona,” according to Kevin McGran of the TORONTO STAR. Attorneys for Balsillie and Moyes also want the judge on Monday to "force the NHL to determine by July 31: Whether Balsillie has been approved as an owner; whether the NHL will allow the Coyotes to be relocated; [and] what a relocation fee for Hamilton would be.” Balsillie said that he has “no problem paying a ‘reasonable’ relocation fee,” and he suggested that the NHL “should prepare a second schedule for Hamilton just in case he’s successful.” McGran notes the legal maneuverings are an “attempt to change a schedule that calls for a Sept. 10 auction for bidders who want to keep the team in Phoenix.” It also “attempts to back the NHL into a corner” because if the league “rejects Balsillie as an owner or rejects the idea of relocating to Hamilton, it could form the basis of an antitrust suit.” The NHL submitted documents Thursday that “called for all parties interested in buying the Coyotes to have their applications to the NHL by June 26.” Preliminary bids are “expected by July 20, with final bids due Aug. 10.” NHL approval for all bidders “will come Aug 24., and the auction will occur Sept. 10.” Moyes and Balsillie are asking the judge to “force the NHL to consider all relocation bids by July 20, offer a decision on Balsillie’s ownership, the transfer to Hamilton and the relocation fee by July 31, and all other bids including relocation by Aug 24” (TORONTO STAR, 6/19). Attorneys for Balsillie and Moyes said that there is “no point in holding two auctions.” In their court filing, they said a single auction “will increase the potential bidder pool and also potentially increase the value to be received for the assets” (GLOBE & MAIL, 6/19).

PLAYERS' POSITION: The GLOBE & MAIL’s Eric Duhatschek notes not every player at Thursday’s annual awards ceremony "necessarily agreed with commissioner Gary Bettman’s position" on keeping the Coyotes in Phoenix. Lightning RW Martin St. Louis: “In terms of hockey-related revenues, we’re partners. It doesn’t mean that Phoenix has to be out. Maybe you have to consider expansion to markets that can support hockey and bring some more revenue. It’s a tough question because you don’t want to see a city lose its franchise, but at the same time, we’re partners. We want to be in markets that we’re going to make the most money.” Red Wings D Nicklas Lidstrom: “If they can keep a team in Phoenix and it’s working, then they should keep it there. But if it’s not working, I don’t think it’s going to work for anyone -- whether it’s the owner or the players. That’s just the reality of it” (GLOBE & MAIL, 6/19).

Persistence NOT Paying Off: In Toronto, Steve Simmons writes the harder Balsillie pushes, the “farther away the NHL gets from him, and by extension, from southern Ontario.” More and more with each passing day, NHL officials “hate his publicity stunts. They hate his overt public relations campaigns. They hate the way he disregards whatever may be going on around the NHL ... and continues in his bull-in-a-china-shop kind of way, blinded by everything but his own ego, hell-bent to bring a seventh NHL team to Hamilton.” Simmons: “You have to admire Balsillie’s naïve persistence. It is oddly commendable. But it also sounds a lot like those phone calls that disrupt your dinner, trying to sell you a vacation. After awhile, you’ve heard one telemarketer, if you’ve heard them all” (TORONTO SUN, 6/19).
