In Dallas, Michaels & Case report law professors in a brief filed yesterday argue that the Securities and Exchange Commission [SEC] "made a legalistic land grab when it sued" Mavericks Owner Mark Cuban in November "for insider training involving a Canadian company, Mamma.com." The professors "argue that the SEC's case rests on a regulation that is 'an invalid exercise of the agency's rule-making authority' and exceeds the scope of case law established by the U.S. Supreme Court." The brief "represents Cuban's latest gambit to undermine the SEC," and an SEC official said that the agency "would respond in writing to Cuban's argument later this month" (DALLAS MORNING NEWS, 2/3).

STAYING ON THE SIDELINES: SI Group Editor TERRY MCDONELL did not attend Super Bowl XLIII in Tampa, instead opting to stay in N.Y. and watch it at the Oak Room at the Plaza in N.Y. with media members. McDonell: "Our sponsors are having very tough years. They can't do it and they shouldn't do it. It wouldn't be prudent." The N.Y. OBSERVER's Reid Pillifant noted advertisers generally "pay for Mr. McDonell and some of his staff to attend the game" (OBSERVER.com, 2/2).

Hockey Classic "Slap Shot"
THAT'S ENTERTAINMENT: Pro Football HOFer Lawrence Taylor "will be named a contestant" on the eighth season of ABC's "Dancing with the Stars," "joining a list of gridiron greats" who have appeared on the show. A formal announcement of the season eight competitors "is set for Sunday" (N.Y. POST, 2/3)....Universal Pictures "is ready to drop the puck" on a remake of the '77 "hockey comedy classic," "Slap Shot." DEAN PARISOT will direct the film, PETER STEINFELD, writer of "21," will write the script and KATHLEEN KENNEDY and FRANK MARSHALL will produce (DAILY VARIETY, 2/3)....ABC Family has picked up "Perfect Ten," a one-hour drama "about a group of teen Olympic gymnast hopefuls," for a 10-episode order (CABLEFAX DAILY, 2/3).

IN MEMORY: Titans co-Owner & Vice Chair NANCY ADAMS, the wife of Titans Owner BUD ADAMS, died Sunday at the age of 84. Nancy Adams’ name was “not often splashed across the newspaper pages,” but she “will be remembered for what she contributed not only to the franchise but also to its surrounding communities.” A memorial service for Adams will be held Thursday at 1:00pm CT at River Oaks Baptist Church in Houston (Nashville TENNESSEAN, 2/3).
