Florida City Suing Indians Over Unpaid Spring Training Revenues

Indians Withheld $107,454 In Spring Training

The city of Winter Haven, Florida, has filed suit against the Indians, alleging that the team "owes the city $107,454 in parking, concession, ticket and advertising revenues" from the Indians' Spring Training stays in the city ahead of the '04 and '05 MLB seasons, according to Merissa Green of the Lakeland LEDGER. The city also is "seeking lawyers' fees and interest on the amount that it said it is owed." Winter Haven City Attorney John Murphy Tuesday said that he "hasn't heard from the Indians' general counsel" since the lawsuit was filed in December in Circuit Court and the team was sent a copy. Green noted the Indians in their contract with the city agreed to "share revenues from parking, concessions, ticket sales and advertising." According to the lawsuit, the city collected parking and concession revenues while the team collected ticket and advertising revenues. Each party then "paid a portion to the other." The suit alleges that the Indians "withheld $100,000 from the 2004 season and $7,454 in 2005." Winter Haven Community Services Dir T. Michael Stavres said that the Indians "withheld the money from the two seasons as a result of costs it had from a dispute it was having with the state Department of Revenue." Winter Haven served as the Indians' Spring Training home from '93-'08, though the team now has "moved its spring training operations" to Goodyear, Arizona (Lakeland LEDGER, 1/14). Indians VP/PR Bob DiBiasio declined to comment on the lawsuit (CLEVELAND.com, 1/14).
