NASCAR Driver Elliott Sadler To Claim GEM Breached Contract

Sadler Plans To Seek Relief And 
Damages From GEM
An attorney for NASCAR driver ELLIOTT SADLER Wednesday filed notice in Iredell County (NC) court saying that Sadler intends to claim that Gillett Evernham Motorsports (GEM) "has breached Sadler's contract" to drive the team's No. 19 Sprint Cup Series Dodge next season, according to David Poole of the CHARLOTTE OBSERVER. Sadler has until January 20 to "file a complaint if the parties cannot reach an agreement on their dispute." Sadler "plans to seek relief and damages." GEM, team Owner GEORGE GILLETT, Ray Evernham Enterprises and driver A.J. ALLMENDINGER, who is expected to replace Sadler in the No. 19 entry this year, are named as defendants in the suit. JOHN BURIC, Sadler's attorney, said that he "did not know there had been negotiations with Allmendinger until he received phone calls about media reports that Allmendinger was being lined up to replace him." Sadler earlier this year signed a contract extension with GEM that runs through '10 (CHARLOTTE OBSERVER, 1/3).

DRIVE-THRU: NASCAR Scene’s Steve Waid writes, “The question is, if Gillett had indeed given Sadler a two-year extension as claimed, why the pursuit of Allmendinger amid the risk of a legal situation?” It seems a “real possibility -- nothing guaranteed, mind you -- that in order to resolve this situation Gillett may have to buy out the last two years of Sadler’s contract.” What is "curious is that when Gillett is in the process of a merger with Petty Enterprises -- which means money will change hands -- the team then hires another driver to replace one who has been given a two-year contract extension" (SCENEDAILY.com, 1/5).
