Marlins Ballpark Suit Next Week 
Miami-Dade (FL) Circuit Court Judge Jeri Beth Cohen yesterday was "expected to issue an opinion" in Miami auto dealer Norman Braman's lawsuit over the public funding of the Marlins' proposed ballpark, but after a brief argument from Braman's attorney, Cohen said that she "saw no problem with waiting until next week," according to Charles Rabin of the MIAMI HERALD. The Florida Supreme Court last week "reversed itself in an Escambia County case and decided that a public referendum is not required when government uses property tax money to pay off large bond debts," and Cohen will wait until the court announces which motions it will rehear. But even if the court agrees to "rehear a motion on the Escambia County case," Cohen said that it "wouldn't sway her opinion." Cohen: "I'm not going to change my mind. I'll sign the order Oct. 2" (MIAMI HERALD, 9/23). In Ft. Lauderdale, Sarah Talalay reported Cohen also "cautioned Braman's attorney Bob Martinez about appealing the referendum count." Cohen: "You can only appeal where the law's not clear. The law is very clear" (SUN-SENTINEL.com, 9/22).

RAW FISH: In Miami, Linda Robertson noted the Marlins this season have a 81-75 record, "far exceeding expectations," yet they will "finish with the worst home attendance" in MLB, averaging 16,688 fans per game at Dolphin Stadium. The Marlins are seeking public financing for a new ballpark, but "does such an unloved franchise deserve a sweetheart deal on a new, $515[M] stadium?" Robertson: "No way. It's an incredibly expensive gamble to think that a new home will automatically make the Marlins popular." The team has won two World Series titles since '97 and are headed for their fourth winning season under Owner Jeffrey Loria, but fans "continue to find a myriad of excuses for not coming to games" (MIAMI HERALD, 9/22).
