Kevin Slaten Barred From St. Louis Airways Until At Least October

St. Louis County (MO) Circuit Judge Larry Kendrick has ruled that former KFNS-FM host Kevin Slaten "must stay off the local airwaves until at least Oct. 5," according to William Lhotka of the ST. LOUIS POST-DISPATCH. Slaten "had been trying to have the 'non-compete' clause in his contract voided, a provision saying he can't work for KFNS competitors for six months after departing." But in an order made public yesterday, Kendrick "barred Slaten from working as an on-air sports personality at any area radio, television or cable station until that time elapses." Kendrick decided that Slaten "was sandbagging" Cardinals pitching coach Dave Duncan during a March 27 interview. Slaten and former KFNS producer Evan Makovsky were fired eight days after the interview. In his finding of facts, Kendrick wrote, "Slaten knew that Duncan was unaware that he would be 'on-air' at the time that Duncan answered the second call to him." Makovsky testified that Slaten "told him to put the second call to Duncan," while Slaten testified that Makovsky "made up that conversation in an unsuccessful attempt to save his own job." But Kendrick "accepted Makovsky's version" (ST. LOUIS POST-DISPATCH, 8/13).
