Judge Rules Donaghy Most Likely
Not Responsible For NBA Fees |
U.S. District Court Judge Carol Bagley Amon said that former NBA referee Tim Donaghy "will most likely not have to reimburse the NBA for the cost of its internal investigation into betting by referees," according to Katie Thomas of the N.Y. TIMES. The NBA is seeking almost $1.4M in restitution from Donaghy, but Amon indicated that she "would reduce that sum, saying that $516,000 the NBA spent to interview 57 referees should not be included." Amon also ordered the NBA to "provide additional details about the legal costs it incurred during the federal investigation of Donaghy." It was not resolved whether Donaghy will "have to pay back portions of his salary dating to 2003" (N.Y. TIMES, 6/26). Amon "chided NBA attorneys for not raising the issue when the court asked last October if the league would be seeking restitution." Amon: "This comes very late in the game." ESPN.com's Mike Fish wrote yesterday's outcome "could best be described as a draw." Donaghy's lawyer John Lauro "seemed to come out ahead on the legal maneuvering," but Donaghy "didn't do much to enhance his public image when he muttered a profanity in the direction of a female reporter after he left the courtroom." A hearing to determine what, if anything, Donaghy owes the NBA is scheduled for July 9 (ESPN.com, 6/25).
