Law Enforcer: Former NHLer Ray Sues NHLPA For Lockout Money

Ray Suing NHLPA Over Payouts
Following '04-05 Lockout
Former NHLer Rob Ray has filed a lawsuit in New York Supreme Court against the NHLPA over the "payout of millions of dollars from the union's so-called war chest" after the '04-05 lockout was resolved, according to Rick Westhead of the TORONTO STAR. Ray in '04 sued the NHLPA after it "excluded him from receiving monthly payouts" that the NHLPA's exec committee distributed to more than 700 players during the lockout, and after Ray in '05 settled that suit, the NHLPA "made lump-sum payouts to both current and former players." A source said that the NHLPA agreed to pay Ray about US$75,000 in the settlement. Ray, who works as an analyst for the MSG net, now is suing for "some of that money and seeking $1[M] in punitive damages." The NHLPA said that Ray "did not receive any money when the lump-sum payments were distributed," because he had "surrendered any legal claims against the union as part of his earlier settlement." The new lawsuit was prompted when Ray earlier this year learned that the NHLPA following the settlement had "distributed money to active and retired payers, with estimates around $150,000 a player." The suit claims the NHLPA "falsely, fraudulently, and with intent to deceive and defraud Ray, represented that it would not make any further distribution of the benefits to the NHL players after the lockout ended." The NHLPA in documents filed last week alleged that Ray had agreed to "[waive] any and all claims against the NHLPA and its assets ... including any future distributions to other former members" (TORONTO STAR, 5/8).
