Kentucky Speedway Owners Claim NASCAR, ISC Withheld Races

Kentucky Speedway Seeking To Have Its Suit
Against NASCAR And ISC Go To Trial
Kentucky Speedway owners, in their appeal of the track's federal antitrust lawsuit against NASCAR and Int'l Speedway Corp. (ISC), said that they are not just a "jilted distributor" and contend that NASCAR and ISC have "worked together illegally to keep independent tracks from hosting Sprint Cup races," according to Bob Pockrass of NASCAR SCENE. According to a redacted version of the appeal, Kentucky Speedway “offers its arguments as to why a U.S. District Court judge should not have ruled in January in favor of NASCAR and ISC without allowing the case to go to trial.” In the appeal, Kentucky Speedway said that NASCAR "denied independent tracks Cup races until they agreed to sell to ISC at below market value." The appeal also claimed that NASCAR "threatened to pull races" from Las Vegas Motor Speedway (LVMS) because the track's owners "refused to sell to ISC; the owners later sold to ISC-rival [SMI].'' NASCAR Managing Dir of Corporate Communications Ramsey Poston "denies that NASCAR threatened to pull races" from LVMS or other tracks. Poston: "It's absurd. It's completely false." Meanwhile, the appeal also alleges that ISC COO John Saunders said in a deposition that Kentucky Speedway would be hosting a "premium stock car race right now if ISC owned it," though ISC "disputes that characterization." ISC Dir of Investor Relations Wes Harris said that ISC "considered purchasing Kentucky Speedway but decided not to because it was not in our financial interest." Saunders also said that had ISC purchased the speedway, it would "not necessarily have received a Sprint Cup race" (SCENEDAILY.com, 4/28).
