NFLPA Committee Votes To Suspend David Dunn For Two Years

The NFLPA’s Committee on Agent Regulation & Discipline (CARD) has voted to suspend
agent DAVID DUNN, who represents about 60 NFL players, including a number
of starting quarterbacks, for two years, NFLPA General Counsel RICHARD BERTHELSEN
confirmed Monday. Dunn has the right to appeal the suspension to NFLPA arbitrator
ROGER KAPLAN. If Dunn appeals, as expected, the suspension would not go
into effect until after the appeal and if the discipline is upheld. Kaplan has
the authority to strike down, uphold or reduce the discipline. Berthelsen would
not comment on the case, but said he hopes an appeal can be heard sometime in
November. Attempts to reach Dunn for comment were unsuccessful.
BACKGROUND: The suspension is based, at least in part, on testimony in
the LEIGH STEINBERG versus Dunn trial in ’02, in which a federal jury in
L.A. found Dunn competed unfairly against his former partner and mentor Steinberg,
and awarded a $44M verdict. That verdict, however, was overturned by an appeals
court, based on errors made by the trial court judge. The NFLPA’s CARD originally
voted to suspend Dunn for two years in ’03, but the discipline and the appeal
were put on hold when Dunn filed for Chapter 11 Bankruptcy protection, which automatically
stays administrative actions against the debtor. Dunn’s bankruptcy proceeding
was dismissed earlier this year.
