Arbiter Rules NFL Fans At Soldier Field Can Be Patted Down

Fans will “again be subject to pat-downs at Soldier Field after an arbiter’s ruling against the Chicago Park District,” which filed a federal lawsuit in July claiming the pat-downs are unconstitutional, according to Charles Sheehan of the CHICAGO TRIBUNE. The arbiter ruled that the contract between the district and the Bears requires that the district “provide security at Soldier Field, including the pat-downs.” The district, “fearing legal costs, refused to check fans before the final two home games last season, disobeying an edict” by the NFL. A judge earlier this month dismissed the district’s suit, “ruling that fans might be able to assert their 4th Amendment rights, but that the district could not do so on anyone’s behalf” (CHICAGO TRIBUNE, 8/27). Chicago Park District Superintendent Tim Mitchell said that the pat-downs “cost about $10,000 per game.” While a judge in Tampa ruled pat-downs at Raymond James Stadium violated 4th Amendment rights, ACLU attorney Adam Schwartz said that “no decision has been made to challenge the Chicago pat-downs.” Mitchell said that he is “bracing for a lawsuit,” and added that the district “is exploring asking the NFL to cover its legal costs.” In Chicago, Andrew Herrmann noted the NFL “reportedly covered legal bills” in the Tampa case (CHICAGO SUN-TIMES, 8/26).
