Santa Clara City Leaders, 49ers Cannot Agree On "Rent Reset" For Levi's Stadium

Santa Clara city leaders say that the 49ers have withheld more than $5M in rent for Levi's Stadium as they are pushing for "lower payments as part" of their deal with the city, according to Ramona Giwargis of the SAN JOSE MERCURY NEWS. City officials said that the deal calls for a "rent reset" allowing the 49ers' rent to be "adjusted based on outstanding debt, revenue and changes in operating costs." City Manager Julio Fuentes said that the 49ers have "met their contractual obligations." Team officials said that they have "since paid up while talks continue." Mayor Lisa Gillmor: "I'm going to ask the city is made whole for their contractual obligations. It needs to be paid." Giwargis noted the dispute "comes after months of heated negotiations" between the two parties over what the team "should pay in rent next year." The original contract "provides a one-time 'rent reset,'" but the sides "aren't agreeing on a new rent amount." The team wants to pay $20.25M, but city leaders are asking for $24.5M. The city has collected $19M from the team this year, but the team was not "sent a delinquent notice" and was not "charged interest on the outstanding payments." City Attorney Ren Nosky said that the team has "agreed to make two payments this month," one of $1.25M and another of $4.25M. 49ers VP/Communications Bob Lange said the team has "made all required lease payments." Lange: "Even after adjustment, the 49ers will pay rent that is more than two times higher than the next highest rent paid by any of the other 31 NFL teams" (SAN JOSE MERCURY NEWS, 3/19).
