Ticketmaster Wants Judge To Quash Subpoena In Super Bowl XLV Case

Ticketmaster is asking a federal judge to quash a subpoena brought by ticketholders who were affected by the seating troubles at Super Bowl XLV at AT&T Stadium in ’11. Ticketmaster is not a defendant, but is the NFL’s official secondary-ticket provider and manages NFL Ticket Exchange. It also handles primary ticketing for most NFL teams. The subpoena was issued in August, and Ticketmaster last week asked the court to quash it, calling it overly broad and unnecessary. Ticketmaster's motion to quash the subpoena noted, “The data that Plaintiffs now seek from Ticketmaster reaches back seven years, is not relevant to claim and defense, would impose an undue burden on non-party Ticketmaster and ultimately will likely reflect, at most, the price the Plaintiffs paid for their particular Super Bowl ticket, information that Plaintiffs already have in their possession." There are two separate actions proceeding in Dallas federal court stemming from the ’11 seating mishaps. There are a handful of individual cases that are proceeding to trial, as well as the Greco case, which encompasses nearly 200 affected ticketholders and was filed last year. It is the Greco case that seeks the Ticketmaster data. One request for data from Ticketmaster reads, “Any and all memoranda, correspondence, guidelines, policies procedures, bulletins, presentations, training materials, instructions, terms and conditions, agreements directives, and all other documents issued or generated by you and provided to the NFL, any NFL franchise, fans, or ticket agent, distributor, or reseller, relating to the sale of obstructed view tickets, or seats with obstructed views, during the time period of January 1, 2007 to the present.”
