NCAA, O'Bannon Plaintiffs Ask To Have Appeal Settled Before August '15 Injunction

The NCAA and the Ed O'Bannon plaintiffs on Friday “asked the federal appeals court hearing their case to resolve the appeal before the injunction from a district judge begins Aug. 1, 2015,” according to Jon Solomon of CBSSPORTS.com. In a joint filing, the NCAA said that “it is ‘critical’ for the appeal to be resolved within the next year.” U.S. District Judge Claudia Wilken has said that, during the appeal, she “will not stay her injunction, which would in part allow schools to pay deferred compensation to players for use of their names, images and likenesses if the amount is not capped at less than $5,000 per year.” The filing states the NCAA “contends that if this appeal is not resolved by that date, then absent a stay the NCAA and its members will, in the NCAA's words, be forced to make fundamental changes to the administration of collegiate athletics and to their relationship with student-athletes.” The appeals court under the current schedule “would not hear oral arguments" until late next year. The NCAA “requested that oral arguments be set for a date” in April or May. Throughout college sports, “there's a wait-and-see approach on what the O'Bannon ruling will ultimately mean.” Clemson AD Dan Radakovich said that he has “started to financially plan three- to five-year forecasts for a future in which the O'Bannon injunction goes into effect.” TCU AD Chris Del Conte said “there's kind of a little bit of a holding pattern” about how to handle the O'Bannon ruling. Del Conte: “Everyone knows what's out there. We just don't know what direction we're going” (CBSSPORTS.com, 9/19).
