Former NFLers Upset With NFLPA's $15M Payout To Upshaw's Family After His Death

The son and widow of GENE UPSHAW have reached a settlement regarding the late NFLPA Exec Dir's estate, which contained a "previously undisclosed $15 million deferred compensation fund the union paid" to Upshaw's widow after his death in August '08, according to Tom Jackman of the WASHINGTON POST. The NFLPA fund emerged in a filing by Upshaw's son, EUGENE UPSHAW III, who "sued his father’s second wife," THERESA UPSHAW, to "have his father’s will thrown out and his stepmother removed as executor of the estate." Terms of the settlement were not released, but the $15M payment "has outraged some retired NFL players, who have long claimed that Upshaw did not represent them as fairly as he did current players during his 25-year career with the union." Jackman notes the file for Upshaw's estate also reveals an additional $1.73M in "past due compensation" from the NFLPA. Court records show that his will was "signed on the day he died." His son contended that Upshaw "was so sick that he could not have been aware enough to know what he was approving" (WASHINGTON POST, 5/5).
