Bill Davis Racing Suing Sponsor 360 OTC Over Unpaid Funds

Bill Davis Racing (BDR) on April 2 filed a lawsuit in North Carolina Superior Court in Winston-Salem against Rockford-Montgomery Labs (RML), which manufactures the medicine 360 OTC, stating that the company has "paid only $25,000 of the $14[M] it was supposed to pay" for OTC's sponsorship of BDR's Sprint Cup Series No. 36 entry last season, according to Bob Pockrass of NASCAR SCENE. The sponsorship was a three-year deal scheduled to increase to $14.5M in '08 and $15M in '09, with a sponsor's option for $15.5M in 2010. According to the suit, RML also "did not pay any of the $3[M] it owed as a primary sponsor for the No. 36 truck and the $1[M] it owed to be primary sponsor for 10 races of the No. 23 truck." Pockrass noted this is the latest in a series of lawsuits against RML, as they recently have been sued by Just Marketing, which was handling the NASCAR sponsorship. A RML attorney did not immediately return a request for comment (SCENEDAILY.com, 4/8).
