"FAVORED-NATIONS CLAUSE" COULD MEAN STADIUM EQUITY IN PHILLY

Included in the city of Philadelphia's lease agreements
with the Eagles and Phillies is "a clause that could wreak
havoc with any plan to build a stadium for one team and not
for the other," according to Christopher Hepp on the front
page of the PHILADELPHIA INQUIRER. The language of the deal
"opens the possibility that if one team gets a new stadium,
the other team could demand a new home of its own as well.
At the least, it appears that the losing team could opt out
of its current lease and move." Known as a "favored-nations
clause," Section 1421 of each lease says the deals are
intended to be "consistent" with each other. Each team is
also given "the right to veto any changes to the other's
lease if those changes 'act to the detriment' of the first
team." Since "the consensus has been that the city is
leaning" toward a new ballpark for the Phillies and
renovating Veterans Stadium for the Eagles, the Eagles
"would appear to be the team most likely to invoke the
     clause" (PHILADELPHIA INQUIRER, 10/19).
