DraftKings, FanDuel Look To Delay Enforcement Of Schneiderman Order

DraftKings and FanDuel today filed petitions with the N.Y. Supreme Court seeking temporary restraining orders against a cease-and-desist order from state Attorney General Eric Schneiderman. The actions, seeking to delay enforcement of that order, follow separate lawsuits filed Friday against Schneiderman. "We also requested an expedited hearing schedule to resolve this matter as quickly as possible," DraftKings said in a statement. "We believe this TRO is necessary and warranted to protect DraftKings' business while we pursue our legal action."

The company continued in its petition, "The Attorney General is pursuing his own political agenda in defiance of the Constitution and the rule of law." As was the case in the lawsuit itself, DraftKings' latest filing claims Schneiderman's action presents a risk of irreparable harm and is having a chilling effect on the company's nationwide operations.

FanDuel, meanwhile, in its similar filing for a temporary restraining order said that because of Schneiderman's action, "FanDuel is now unable to accept deposits from its customers in New York, causing incalculable, immediate and irreparable harm to FanDuel's business. The merits of this matter should be resolved by the judicial process, and FanDuel is entitled to its day in court."
